Conditions for use
So that you can use this site, we would ask you to read the following rules and conditions carefully. They must then be expressly accepted. Should you not accept these conditions, we ask you to refrain from using the site. In any case, use of this site implies explicit acceptance of the following rules.
1. Limitations on using the material
This site is the exclusive property of Lelli Kelly SpA and is managed by the company or by persons given the responsibility for so doing. Everything that appears there is the property of Lelli Kelly SpA or is material that Lelli Kelly SpA has been authorised to use. It is therefore forbidden to copy, reproduce, publish, download, use or allow to be used, transmit or distribute, by any means, in whole or in part, material taken from this site, except for the right to download a single copy on to a single machine for personal use only and for purposes that are strictly not commercial, and only so long as the attributions and source of author’s rights, patents, trade marks and other rights in intellectual property, all of which are exclusively due to Lelli Kelly SpA, are preserved. Imitation or any use of material taken from this site for other purposes constitutes violation of the author’s rights and the other rights in intellectual property belonging to Lelli Kelly SpA. Software downloaded from the site, such as files and images contained in them are licensed for use by Lelli Kelly Spa without such concession implying any transfer whatsoever by Lelli Kelly SpA to the User of any entitlement to rights in the software. The User, therefore, possesses only the support material on which the software is installed and has no property in nor management of rights in intellectual property which remain with Lelli Kelly SpA, and the User therefore does not have the right to distribute, publicise, sell, take apart, dismember, disassemble, rework or change the software on this site.
2. Exclusion of any guarantee
The material relating to this site is made available to the User without any guarantee, whether explicit or implied, in conformity with the law within the limits allowed by said law and therefore Lelli Kelly SpA does not provide any guarantee including such as relates to the quality promised or suitability or any other use of the material, such as that the said material is free of interruptions or other faults or that said faults will be corrected or that the server or the site are free of viruses or other prejudicial or harmful elements, or in relation to the use or results consequent on the use of material taken from the site, and therefore each and any consequence concerning the use of said material or the impossibility of using it will be solely and exclusively at the User’s responsibility.
3. Territory
The material presented on the site has the sole purpose of promoting the products of Lelli Kelly SpA in Italy and in any other country in which Lelli Kelly SpA intends to promote and sell its products from time to time, but Lelli Kelly SpA gives no guarantee in relation to the legitimacy of the use of the material on the site in territory outwith Italy. Access to the site from other places outwith Italian territory is regarded as carried out at the User’s exclusive initiative and the User assumes full and exclusive responsibility therefor, for which Lelli Kelly SpA cannot in any way be held responsible.
4. Duration
These rules bind the User up until the time he withdraws which happens whenever said User destroys the material received or taken from the Lelli Kelly SpA site, such as documentation, copies and relative installations, including such as were obtained in contravention of these rules. For its part, Lelli Kelly SpA may at any time challenge any contravention of the rules in force as regards use of the site and which regulate the protection of rights in intellectual property. In that case, the User will be bound to completely destroy the material obtained, taken, extracted or inferred from this site, such as any copy of same, in whatever the way said material was obtained.
5. Final clause
This contract is regulated by laws currently in force in Italy. For any dispute regarding interpretation, application and/or execution in relation to the regulation of this site, the sole competent forum will be the Court of Lucca, unless there be exceptions in the law.
